IPS officer G P Singh receives relief as HC stays Durg court trial

staying the Durg court trial against him in an
alleged extortion case
.
Singh filed a petition in the High Court seeking the quashing of the trial based on a case filed against him at the
Supela police station
in Bhilai under Sections 384 and 388 of the IPC.
In 2015, there was a dispute between Durg resident Kamal Sen and builder Singhania regarding a commercial transaction. During this dispute, Singhania allegedly threatened Sen by mentioning IPS GP Singh, though no direct conversation between them occurred.
Himanshu Pandey, counsel representing the IPS, stated that six years later, in 2021, Kamal Sen lodged an
FIR
at the Supela Police station in Bhilai, alleging that G P Singh demanded Rs 20 lakh from him and threatened him. Based on the complaint, a case of intimidation was registered against Singh at the Supela police station, and a trial was ongoing in the Durg court.
To quash this FIR, IPS Singh filed a petition in the High Court. The case was heard by the Division Bench of the court. The Court observed that reporting to the police after six years by the complainant is a considerable lapse of time. Furthermore, obtaining permission under Section 197 to file a criminal case against a public servant, which is mandatory, was not sought. Additionally, the High Court has imposed a stay on this FIR.
IPS G P Singh faced various criminal charges during the previous regime in Chhattisgarh. He served jail term. Recently the Central Administrative Tribunal ordered the state government to quash all cases against him within four weeks and reinstate him.
